Appeal begins over man acquitted of killing Cindy Gladue – The Star

The Crown argues the trial judge should have explained to the jury that Bradley Barton could have been guilty of a lesser charge.

EDMONTON—An appeal has begun over the acquittal of an Ontario trucker who was charged with killing an indigenous woman.

A jury last year found Bradley Barton not guilty of first-degree murder in the death of Cindy Gladue, a 36-year-old sex trade worker who was found dead in a bathtub in an Edmonton motel room in 2011.

Gladue died after a night of what Barton called consensual, rough sex.

The Crown is arguing that the trial judge should have explained to the jury that Barton could have been guilty of a lesser charge if he should have foreseen his actions would harm Gladue.
