Plantiffs in Nicholas case support Senate amendments to Bill S-2
The federal government is asking a B.C. court for more time to pass legislation to address a section of the Indian Act the court found unconstitutional.
According to legal documents, the Government of Canada has asked the British Columbia Supreme Court to extend the suspension of the ruling in Nicholas v. Attorney General (Canada) for another six months.
The decision found that Section 6(1)(d) of the Indian Act discriminates against those who were enfranchised (lost Indian status) and their descendants, violating their Charter rights. The court declared that section invalid but suspended the ruling for 10 months to give the government time to amend the Indian Act.
