Public engagement on ATIPP underway

YELLOWKNIFE (April 18, 2016) – The Department of Justice has started an engagement process to seek the views of the public on changes to the Access to Information and Protection of Privacy Act (ATIPP Act).

The Government of the Northwest Territories is preparing to respond once all feedback has been examined to ensure residents have access to information while protecting personal information. The ATIPP Act plays an important role in maintaining government accountability and transparency and relates to priorities set out in the mandate of the 18^th Legislative Assembly.

The document, Public Engagement – Access to Information and Protection of Privacy Act, provides information about the ATIPP Act and sets out a number of issues and questions. Members of the public are invited to find out more information about this legislation and provide their suggestions and comments for improvement either electronically or through written submissions.

The information document and feedback form are available at www.justice.gov.nt.ca. Submissions will be accepted until June 15, 2016.

In 1996 the Access to information and the Protection of Privacy Act (ATIPP) came into force.
Changes were made to the ATIPP Act in 2004 and 2005 to address issues that had been raised by stakeholders.
The ATIPP Act gives members of the public the legal right to request access to information held by NWT government departments and public bodies, and the right to correct personal information.
The legislation sets out when a public body may collect, use and disclose personal information. Refusals to disclose records may only occur if there is a statutory exception.
Other statutes also cover the area of privacy and access to information such as the Health Information Act. This review only concerns the NWT Access to Information and Privacy Act.
