RHTLF Bulletin update on Joanna Hammond et al v. Serpent River First Nation

The Robinson Huron Treaty Litigation Fund (RHTLF) issues this statement to update all 21 Robinson Huron Treaty (RHT)member First Nations regarding yesterday’s decision of the Federal Court of Canada to dismiss an application for judicial review. The application is related to Serpent River First Nation’s decision on the per capita distribution amount from its share of the Robinson Huron Treaty Settlement Agreement proceeds.

The Court’s dismissal of the judicial review removes another challenge to the validity of the compensation process outlined in the Settlement Agreement – particularly the ability of the RHT First Nations to adopt a distribution approach that it determines is in the best interests of their current and future membership.

With this decision, and the decision to dismiss the Garden River First Nation judicial review on similar grounds, the RHTLF will continue supporting RHT First Nations’ compensation distribution efforts.
