Superior Court of Quebec dismisses claim filed against MCK

(Kahnawake – 22 Onerahtohkó:wa/May 2026) The Mohawk Council of Kahnawà:ke (MCK) wishes to inform the community that the judicial proceeding brought forth by Elvin “Jason” Diabo (the claimant), a community member operating under the name Wild Wild West has been dismissed by the Superior Court of Quebec on 20, Onerahtohkó:wa/May 2026.

On June 1, 2020, a community member operating under the name Wild Wild West initiated proceedings before the Superior Court of Québec against the MCK and Tewatohnhi’saktha, seeking damages in the amount of $1,795,303. The claim alleged business losses arising from roadwork undertaken by MCK on Route 207 in the fall of 2018, which was claimed to have affected customer access to the business.

The works were intended to rehabilitate the intersection of Route 207 and Highway 30. This included road widening and the installation of water and sewer infrastructure to support potential future service connections in the area.

Due to the claimant’s opposition to the work being carried out at that time the project was subsequently delayed. Furthermore, as a result of the legal proceedings being commenced the roadwork has yet to be completed.

The Wild Wild West business is situated on common land designated for the exclusive use of Tewatohnhi’saktha for economic development purposes, which acquired the lot in 2005. The lease between the parties expired in February 2025. No rent was collected from the occupant after April 2021.

In addition to the dismissal of damages sought by the claimant, the Court also ordered the occupant to vacate the premises and remove all personal property and structures within 90 days of the decision. In addition, the Court issued an order prohibiting any obstruction of the planned works.
