Fort Nelson First Nation wins legal challenge: Province’s attempt to avoid environmental assessment for major frack sand mine overturned

FORT NELSON, BC, July 13, 2015– The first frack sand mine proposed for FNFN territory is now on hold because the BC Supreme Court found that the Province unreasonably determined the project was not reviewable under environmental assessment law. The Court rejected the Province’s “uncritical acceptance” of Canadian Silica Industry Inc.’s approach to the project, which put the developer’s commercial interests ahead of FNFN treaty rights and the public interest in environmental protection.
