On Monday, 17 August 2015, the Federal Court of Appeal dismissed the Hamlet of Clyde River, the Nammautaq Hunters & Trappers Organization – Clyde River, and J. Natanine’s application for judicial review related to MKI’s marine seismic survey authorization.
The Court concluded that the applicants had standing to bring the application, the Crown adequately fulfilled its duty to consult with the Inuit in regard to the project, the National Energy Board did not err in issuing the Geophysical Operations Authorization, and the Crown was not obligated to seek the advice of the Nunavut Wildlife Management Board.
